Amazon and GoPro joined forces to face counterfeiters in a lawsuit on Monday, in which seven individuals and two entities were involved in breaching Amazon’s policies and infringing GoPro’s trademark by trying to sell products which included the floating hand grip, “The Handler,” and the “3-Way” grip, extension arm, and tripod mount.
Amazon, GoPro file a lawsuit against nine defendants
The nine defendants allegedly used GoPro’s trademarks without authorisation to blindside customers about the authenticity and origin of the products. In addition, the defendants also tried to create a false affiliation with GoPro. Amazon immediately blocked the defendants’ selling accounts and refunded customers who were affected by this.
“When counterfeiters attempt to sell in our store, they not only violate the intellectual property rights of companies like GoPro, they also mislead consumers and harm Amazon’s reputation as a place to buy authentic goods,” said Kebharu Smith, Director of Amazon’s Counterfeit Crimes Unit.
Amazon says that in 2020 they invested more than $700 million (more than R10 trillion) and employed more than 10 000 people to proactively protect its store from fraud, counterfeit, and abuse. Amazon has also been using some of the best tools in the industry to verify potential sellers’ identities and ensure product listings are authentic. Amazon reports that only 6 % of new sellers actually passed the verification stage to start selling on Amazon.
