According to the court documents, Banks failed to deposit the required rent into the court registry after filing an answer to the eviction notice.
This failure led to a motion by the plaintiff to strike Banks’ defence and issue a default judgment for possession of the property.
Banks had rented the property located in Palmetto Bay and reportedly failed to pay the past-due rent, prompting the landlord to seek legal action.
The documents indicate that Banks’ defence was deemed insufficient because she did not provide the necessary documentation to support her claim of a settlement agreement with the landlord.
The plaintiff’s motion argued that Banks’ attempt to delay the process by filing a motion to determine rent was unsubstantiated and did not include any evidence of payments or agreements.
Additionally, the statute cited by Banks in her defence was found to be irrelevant as it pertained to non-residential leases, which did not apply to her residential eviction case.
The court was asked to strike Banks’ answer and enter a default judgment, which would allow the landlord to regain possession of the property. The motion also requested that the clerk issue a writ of possession and that the Sheriff of Miami-Dade County enforce the eviction.
Banks’ legal troubles come after a series of financial and professional issues, including disputes with other landlords and business partners.
